Workplace Injuries Outside of Workers’ Comp
WORKPLACE INJURIES CAUSED BY A NON-EMPLOYEE. HURT BY A 3RD PARTY–CALL/TXT JAKE GUNTER
If you have been injured in the workplace, you probably know about workers’ compensation limits. If not—workers’ compensation or workman’s comp is financial compensation that comes from your employer when you have been injured while in the line of working duty. What many people do not know is that they may be able to sue for damages caused by your injuries.
At Howard, Lewis & Petersen, our Provo personal injury lawyers have helped many clients seek compensation for injuries that were caused by an accident at work and otherwise. With over 50 years of experience, we can help you know whether you have a good case.
Although workers’ comp can provide financial help and benefits to an injured worker, temporary and permanent disability payments are usually quite low and don’t cover things like pain and suffering. Nor do workers’ comp provisions provide punitive damages intended to punish an employer for poor safety controls or dangerous conditions.
Situations in which you may pursue a lawsuit for damages caused by your injuries:
- If you were injured by a defective product, you may be able to bring a products liability suit against the manufacturer, designer, or seller of the product.
- If you were injured by a toxic substance, you may be able to bring a toxic tort lawsuit against the manufacturer of the substance.
- If you were injured because your employer failed to take proper safety precautions in a given situation, or because of their intentional or egregious conduct, you may be able to bring a personal injury lawsuit against your employer.
- If your employer does not carry workers’ comp insurance, you may be able to sue your employer in civil court or collect compensation from a state fund.
- If a third party caused you injury, you may be able to bring a personal injury lawsuit against them.
